Przedłużanie zaświadczeń

Przedłużaniu okresu ważności zaświadczeń kwalifikacyjnych podlegają zaświadczenia kwalifikacyjne z zakresu obsługi oraz konserwacji urządzeń technicznych.

Urząd Dozoru Technicznego przedłuża okres ważności zaświadczeń kwalifikacyjnych wydanych przez UDT na podstawie:

• ustawy z dnia 21 grudnia 2000 r. o dozorze technicznym;
• ustawy z dnia 9 listopada 2018 r. o zmianie ustawy o dozorze technicznym;
• rozporządzenia Ministra Przedsiębiorczości i Technologii z dnia 21 maja 2019 r. w sprawie sposobu i trybu sprawdzania kwalifikacji wymaganych przy obsłudze i konserwacji urządzeń technicznych oraz sposobu i trybu przedłużania okresu ważności zaświadczeń kwalifikacyjnych. Zwanego dalej rozporządzeniem.

Zgodnie z Art. 3 ustawy z dnia 9 listopada 2018 r. o zmianie ustawy o dozorze technicznym, wszystkie zaświadczania wydane przez UDT na podstawie postępowań wszczętych przed dniem 01.06.2019 r. tracą ważność w dniu 01.01.2024 r. Zaświadczenia kwalifikacyjne wydane na podstawie postępowań wszczętych po 01.06.2019 r. tracą ważność zgodnie z datą na zaświadczeniu.

WAŻNE. Zaświadczenia kwalifikacyjne z zakresu obsługi i konserwacji urządzeń technicznych wydane na podstawie postępowań wszczętych przed dniem 01.06.2019 r. nie posiadają na dokumencie daty ważności w związku z czym tracą ważność 01.01.2024 r.

WNIOSEK

Zgodnie z art. 23 ust. 2c ustawy z dnia 21 grudnia 2000 r. o dozorze technicznym w celu przedłużenia zaświadczenia kwalifikacyjnego należy złożyć wniosek o jego przedłużenie nie później niż do 3 miesiące przed dniem upływu okresu ważności zaświadczenia.

WAŻNE. Wniosek może złożyć tylko osoba, na którą wydane jest zaświadczenie.

WAŻNE. Wniosek można złożyć tylko do jednostki dozoru technicznego (UDT, TDT, WDT), która wydała zaświadczenie. Urząd Dozoru Technicznego proceduje wyłącznie wnioski dotyczące zaświadczeń kwalifikacyjnych wydanych przez UDT.

WAŻNE. Certyfikaty ukończenia kursu w zakresie obsługi wózków jezdniowych podnośnikowych (wydany przez ośrodek szkolenia) jak również wydane na ich podstawie wewnątrzzakładowe zezwolenia imienne (wydane przez pracodawcę), o których mowa w § 4 ust. 1 pkt 2 rozporządzenia Ministra Gospodarki z dnia 10 maja 2002 r. w sprawie bezpieczeństwa i higieny pracy przy użytkowaniu wózków jezdniowych z napędem silnikowym (Dz. U. poz. 650 oraz z 2003 r. poz. 603) nie są zaświadczeniami kwalifikacyjnymi w myśl zapisów rozporządzenia Ministra Przedsiębiorczości i Technologii z dnia 21 maja 2019 r. w sprawie sposobu i trybu sprawdzania kwalifikacji wymaganych przy obsłudze i konserwacji urządzeń technicznych oraz sposobu i trybu przedłużania okresu ważności zaświadczeń kwalifikacyjnych (Dz. U. 2019, poz. 1008). W związku z czym nie podlegają powyższemu procesowi przedłużenia.

Składając wniosek wnioskodawca oświadcza, że przez co najmniej 3 lata w okresie ostatnich 5 lat ważności zaświadczenia (np. dla zaświadczeń ważnych do dnia 01.01.2024 r. okres dotyczy lat 2019 – 2023) osoba zainteresowana wykonywała czynności w zakresie określonym w zaświadczeniu kwalifikacyjnym.

Składając oświadczenie wnioskodawca oświadcza dodatkowo, że jest świadom odpowiedzialności karnej za złożenie fałszywego oświadczenia, wynikającej z art. 233 § 6 ustawy z dnia 6 czerwca 1997 r. – Kodeks karny.

Wniosek można złożyć w formie elektronicznej poprzez portal eUDT - portal klienta do tego celu potrzebny jest profil zaufany lub podpis kwalifikowany.

Dla osób nieposiadających profilu zaufanego lub podpisu kwalifikowanego wniosek o przedłużenie okresu ważności zaświadczenia kwalifikacyjnego można pobrać ze strony Wnioski i formularze.

W przypadku złożenia wniosku o przedłużenie okresu ważności zaświadczenia kwalifikacyjnego po terminie 3 miesięcy przed dniem upływu ważności tego zaświadczenia, zaświadczenie nie zostanie przedłużone.

ZASADY WYBORU ZAKRESU PRZEDŁUŻANEGO ZAŚWIADCZENIA

Składając wniosek należy wybrać „rodzaj urządzenia technicznego” zgodnie z klasyfikacją określoną w załączniku nr 3 kolumna b do ww. rozporządzenia.

• Zasady wyboru odpowiedniego zakresu przedłużanego zaświadczenia ważnego do dnia 01.01.2024 r. (nie posiadającego na dokumencie daty ważności):
  • jeden wniosek odpowiada jednemu rodzajowi urządzenia zgodnego z ww. rozporządzeniem (jedna grupa urządzeń; jeden wiersz z załącznika nr 3 do ww. rozporządzenia);
  • w przypadku przedłużenia okresu ważności zaświadczenia kwalifikacyjnego posiadającego w swoim zakresie dwa lub więcej rodzajów urządzeń określonych w załączniku nr 3 do ww. rozporządzenia, osoba zainteresowana może złożyć wniosek o przedłużenie okresu ważności zaświadczenia dla każdego rodzaju urządzenia oddzielnie po spełnieniu warunku określonego w art. 23 ust. 2c oraz art. 23 ust. 2d ustawy z dnia 21 grudnia 2000 r. o dozorze technicznym (Dz. U. 2021, poz. 272).

• Zasady wyboru odpowiedniego zakresu przedłużanego zaświadczenia ważnego zgodnie z datą ważności zamieszczoną na dokumencie:
  • jeden wniosek odpowiada jednemu zaświadczeniu,
  • zakres takiego zaświadczenia jest zgodny z ww. rozporządzeniem, w związku z czym należy wybrać zakres zgodny z posiadanym zaświadczeniem.

WAŻNOŚĆ PRZEDŁUŻONYCH ZAŚWIADCZEŃ KWALIFIKACYJNYCH "NOWYCH"

Okres na jaki będą przedłużane uprawnienia jest zależny od rodzaju i zakresu kwalifikacji i zostaje przedłużony na okres określony w kolumnach c tabel w załączniku nr 3 do rozporządzenia, nie krótszy niż 5 lat i nie dłuższy niż 10 lat, w zależności od rodzaju urządzenia technicznego, stopnia trudności w jego obsłudze i konserwacji oraz stopnia zagrożenia, które może spowodować.

Okres ważności przedłużonego zaświadczenia („nowego”) liczony jest od daty upływu okresu ważności posiadanego zaświadczenia. Zaświadczenie kwalifikacyjne nieposiadające na dokumencie daty ważności (wydane na podstawie postępowań wszczętych przed 01.06.2019 r.) straci ważność z dniem 01.01.2024 r., natomiast zaświadczenie, na których widnieje data ważności, zgodnie z tą datą.

Do czasu kiedy posiadane zaświadczenie kwalifikacyjne nie straci ważności, osoba posiadająca przedłużone zaświadczenie („nowe”) nie będzie mogła się nim posługiwać.

WERYFIKACJA

 Właściwy Odział UDT rozpatrzy wniosek bez zbędnej zwłoki. Wnioski niekompletne nie będą rozpatrywane.

Po weryfikacji wniosku i w przypadku stwierdzenia niezgodności danych na wniosku wnioskodawca jest powiadamiany   o konieczności dokonania niezbędnych uzupełnień w terminie do 7 dni. Jeżeli klient nieuzupełnieni wniosku w terminie 7 dni, postępowanie uznawane jest za zakończone. O tym fakcie zostaje poinformowany za pomocą dostępnych środków komunikacji, w tym środków elektronicznych.

The facility is adapted in terms of providing accessibility to people with special needs for the customer service office (CSO) located on the first floor level. The main entrance to the building is from Kosciuszko, a gate in the fence is equipped with a video intercom connecting to the CSO. To the right of the entrance to the UDT is a ramp, providing access to the side entrance to the building, which is equipped with a video intercom and is suitable for people with limited mobility. Access from the level of the side entrance to the first floor of the building is provided by a wheelchair stair climber, which can be used with the assistance of a trained UDT employee. Appropriate signage has been placed in front of the building and inside, as well as information boards on how to get around the facility. By car, the UDT premises can be accessed through a gate from Kosciuszko Street, equipped with a video intercom accessible from the vehicle's window, connecting with a CSO employee. Directional signage has been erected on the premises indicating access to the designated parking space in the internal parking lot for people with disabilities at the side entrance. Video intercoms allow audio-visual contact with a UDT employee. After receiving information at the COS about the required assistance, the UDT employee introduces a person in a wheelchair using a wheelchair stair climber, while providing voice information about the layout of the rooms in the building to which the person wants to access in order to handle an official matter, as well as to use the toilet room for people with disabilities. The building provided information on the layout of the premises visually and by voice - with the help of a trained UDT employee. The building is not equipped with a passenger lift.

Moving around UDT buildings

In accordance with the safety rules at Office of Technical Inspection, guests and visitors are not allowed to move around the building on their own. They are always accompanied by people inviting or conducting cases. They ensure that you can reach the right rooms and provide the necessary support. Persons using the assistance of an assistance dog or a guide dog may enter UDT buildings in accordance with the rules described above.
